Tomorrow morning there will be a vote in the State Legislature of Nevada on AB329. This legislation essentially redefines the terminology and denies horses water on public land.

The State Constitution of Nevada recognizes Federal Authority of policy of management on public land and the State gives over that authority clearly in the state Constitution.

Oath of Office:

Members of the Legislature, and all officers, executive, judicial and ministerial, shall, before they enter upon the duties of their respective offices, take and subscribe to the following oath:

I, ……………., do solemly [solemnly] swear (or affirm) that I will support, protect and defend the Constitution and government of the United States, and the Constitution and government of the State of Nevada, against all enemies, whether domestic or foreign, and that I will bear true faith, allegiance and loyalty to the same, any ordinance, resolution or law of any state notwithstanding, and that I will well and faithfully perform all the duties of the office of ……………., on which I am about to enter; (if an oath) so help me God; (if an affirmation) under the pains and penalties of perjury.  [Amended in 1914:  proposed and passed by the 1911 Legislature, agreed to and passed by the 1913 Legislature, and approved and ratified by the people at the 1914 General Election. See: Statutes of Nevada 1911, p. 458; Journal of the Assembly, 26th Session, p. 20 and Journal of the Senate, 26th Session, p. 37

Those continuing to propose these types of legislation fail to recognize Federal Authority and The State Constitution. The continued introduction of bills like this and SJR5 waste the time of the state Legislature and the public.

Perhjaps there is a bold state Legislator willing to ask that those that continue to waste time be held responsible through sanction or reprimand?

PLEASE do not be distracted by this and get those comments on the BLM strategy dovument sent in TODAY!

Quick Update

I have had my hands full these last few days. Attempting to dig out of the hole left after documenting  non-stop and attempting to get information out to you as fast as I could. Trust me the hole is deep…

Legal Action

As a journalist attempting to gain access to view the “hands on” care of wild horses and burros by the Bureau of Land Management legal action needed to occur to protect the First Amendment. The case is still pending.

Right now if you choose to support the legal case heading for the ninth (help to cover the past and current costs, like a filing fee that will come due quickly) Gordon Cowan has agreed to accept contributions direct from the public.

Gordon Cowan of Reno Nevada is the attorney that is handling this important case on the publics “right to know” in an area that carries significant public interest.

My work

I have been advised to begin a non-profit that stands as a primarily educational vehicle. I am in the process of creating that vehicle. It will take several months until the 501 status is granted. But you all saw that recently… it will happen.

In the meantime I am working on a website for the non-profit and editing footage. I am tracking horses from Antelope. I am researching and preparing documents for the next stages of the court case.

I can take contributions to continue my work and to assist in the forming of a non-profit.

I am working on my comments and will submit them soon. Please read the document and note in your comments the sections relevant to each and omissions in the document that pertain to your comment clearly as omissions  on the subject in the document that should have been included. It appears the BLM may likely reject comments that are not directly related to the above linked document.

And I wanted to take a minute as I begin to track horses from Antelope to remember those from last years Calico Roundup that landed at Broken Arrow (Indian Lakes). We had a unique opportunity to grow to know so many of those horses as they all landed in one facility… some awaiting sanctuary like those with Return to Freedom… (General, Commander, True, Tommahawk, Redman… so many that we wont loose because Return to Freedom is trying, through sanctuary proposals, to bring them home).

I have not yet attempted to tell the story of the last 15 months… I have worked with so many great organizations that I know it gets confusing. But hopefully creating a “base” organization will help me to get the information out in a faster, more accurate form. To get others into the field and create a more stable way of operating for them than it was for me. I can’t begin to describe what things were like…. but I’ll get there… in all the detail.

Nevada and property of the US government.

I wrote this piece last week after the Phoenix conference but have had a few things on my plate after deciding to leave Grassroots horse. I am working on an infrastructure that will enable the kind of public driven/public participation project that I have always desired. I will keep you posted as details solidify and let you know how to support Gordon Cowan, my attorney, moving forward with the First Amendment case.

After writing this piece several events have occured that make the assertions in SJR5 all the more bizarre.

Let’s take a look at the investigation that the public desired to occur over humane violations of Nevada law.  First games were played about jurisdiction on a local level. Then an “in house” investigation occured by the BLM. I was there as that “investigation” occured and literally listened as BLM personnel gasped at some of what they witnessed. If an “in house” investigation were occuring the statements of the “in house” personnel would have been enough to solidify actions against conduct, y’ think?

In this instance the local governments, state government, bow to the authority of the Federal government over US public property. The Nevada State Constitution recognizes Federal authority on the over 80% of state land that is US “property.”

But now comes SJR5.

The state Legislature of Nevada has passed through the Committee of Natural Resources SJR5. This legislative move has NOT passed the entire Legislature (it was referred to the committee), nor has it yet been approved by Gov. Sandoval.

The intent is to send this document to Congress and the Vice President to urge them to follow the law. Law that the State Legislature claims disallows the Secretary of the Interior the right to determine where wild horses exist on public land (owned by all Americans) and right to determine what a thriving ecological balance is to enrich the American public under multiple use.

SJR5 insists that the greater use of public land for the American people is to continue to expand mining and livestock use while ignoring the growing desire of the public for preserves and sanctuaries to protect the wild herds.

The law (Wild Horse and Burro Act Sec.4) states:

Nothing in this section shall be construed to prohibit a private landowner from maintaining wild free-roaming horses or burros on his private lands, or lands leased from the Government, if he does so in a manner that protects them from harassment…

Note: the Secretary also has the discretion to return the land originally designated as Herd Areas to the management of wild herds.

The law currently gives the Secretary discretion to approve private sanctuaries (such as Mustang Monument and Return to Freedom’s proposal) that will give something back to the American people. Sanctuaries have been proposed on private land and land leased (through existing grazing allotments) that will allow the public to view and learn about their heritage. These proposals offer the public an opportunity to enjoy their land and learn of the history unique to this country. These proposals “give back” to the local community through sustainable jobs that have a low impact to the environment through tourism and community involvement.  The state of Nevada has a real opportunity to show the world that the industrialization of its nation does not have to come at the cost of the environment and public pride through the destruction of the very symbol of the spirit that made the American West great. Most importantly the assertion that proposals such as Mustang Monument and Return to Freedom are not within the scope of law is false.

Currently our wild horses and burros are stockpiled in a warehouse system that is off limits to public view, exists on land NOT designated for horses in the Act and operates at considerable tax-payer expense. To allow the public, through projects such as Mustang Monument, to be enriched through educational and therapeutic programs at less cost to the tax-payer than the current system only follows common sense.

Fear of change has always been a great stumbling block to progress. We urge you to contact the State Legislature and Governor Sandoval and tell them that you do not fear change that is long overdue in this great state. Historic prejudices must be overcome for the progress to occur that makes America as resilient and strong as our symbol of freedom, the American Mustang.

The lawsuit is protected and at this writing it is solid. Gordon Cowan will continue with me as Plaintiff and client, as he has grown to understand this issue in depth and it’s importance. Details to follow.

Please understand I am in no way “stepping back.” I am taking care of issues and am working for the horses as I have always done… my work has existed in many forms and will continue to be as consitentantly there for the herds and getting information to you.

In the spirit of transparency I will make a public thank you to all of you that donated to further my work. Your donations help me find a cheap 4 wheel drive, cameras (one that broke at Antelope). My departure from Grassroots is simply my choice to leave.

Just wanted to let you all know I have left Grassroots Horse.

I am no longer receiving your donations to support my work through Grassroots Horse.  At present I am not operating with an affiliation. I will continue to advocate for the horses, as I always have, but need to explore a more stable way to exist.

edited to add: you misunderstand.. I have not “left the horses” nor my work. I need to explore another “way of being” that offers more stability to be more effective. The stress on my face in Phoenix did show fatigue… but for varied reasons. I had to stay focused “out there” and now there is much that needs to be taken care of that was put aside.

By no means have I stopped working… it just needs to take a different shape. I will update soon with information for those that wish to support the work.

It takes time to get everything formated and uploaded. There is more to bring those of you that couldn’t be there… and folks will get to things as fast as they can.

Right now be sure to get your comments in on the strategy document. It is interesting that many seem to be getting interesting responses from Deb Collins at the BLM. Seems the woman that adamantly insisted, face-to-face at Silver King, that the BLM website is the most accurate source of information… at the exact time the removal count was off by over 100 animals and the whereabouts of  three loads (including the load I followed to Gunnison prison) were glaringly absent from the exact website she continually parrots is accurate… is again insisting that comments are not accurate because the videos and emails come from groups making money on this.

I slept in my truck the last two nights. Last I saw Deb Collins she had a new dye job and a french manicure. Nice government job… bet she has paid vacation, health insurance and a retirement fund. I wonder exactly who is putting out info to keep income coming in?

Today I sat at Palomino Valley for awhile. Horses are being seperated for what appears to be adoption events. It’s that time of year again… So I sat and listened to the horses calling to each other… and had my heart stolen, yet again, by a wonderful curious little gelding with a great butt. Of course he has no tag… kept touching my head and arm… beautiful eyes.

It’s been a long road… The sense of  ”the game” still fresh from Phoenix… and listening to these horses call for each other… still stunningly beautiful in captivity… I sat and cried.

In Phoenix I called this issue “obscene.” It is an obsenity that in MY COUNTRY that I still believe in this mechanism of greed  tramples over our Constitutional rights as it literally genetically bankrupts, toward extinction, this amazing symbol of freedom…

Back to work.

Phoenix, Forward

What can I say? It was another Wild Horse and Burro Advisory Board Meeting. I went. Not because I feel that the board has any meaning except to act as an illusion of public participation in process. The Board sleeps half the time and has no real legal authority… and NOTHING REAL every comes out of the meetings… from the Board. However I did attend as another voice and “warm body” to represent our herds.

Many other wonderful people were there. I am not going to start naming because I will miss someone and end up editing this entry for days. I do not have time to create a slideshow or edit video but I am posting a few pics to share.

Do not, for one second, believe there is no funding for summer. Do not, for one second, believe this is “time off.”

Funding will be pulled from another agency or program. The “balls to the wall” pace of the last year will continue. The agenda has not changed no matter what words are printed, spoken or drawn in the sand. The actions on the range, in holding, hidden in closed facilities remains unchanged.

There is no “New Direction” until the train is a hundred miles down track no one has even laid yet.

I’m back out… and the pace will pick up not slack off. This IS NOT “time off.” It is time to reload…

WE need a Congressional investigation into this program… no NAS study with parameters given to them by BLM, no internal investigation into contractor actions, no “observers” provided by a 501 that may very well be illegally operated and a conflict of interest for an Advisory Board Member… no more.

We need something tangible from Abbey now.

For starters let’s try transparency of actions…   OPEN closed facilities to the public, approve sanctuaries that give something back to the tax payer, start making lease holders actually pay for the cost of their leases and stop running an entitlement program on public land… AND adhere to the most basic premise of the act and start treating these animals in a humane fashion according to today’s standards and NOT some 1800′s cowboy mentality.

Am I really asking too much in a supposedly civilized nation?

Let me simplify…

Let me try to simplify the “foal incident” of the second of March. Seems there are a number of folks that were not present that have taken it upon themselves, for one reason or another, to determine what actually occured. To determine (as they were NOT present) that my information is not correct. (You all know I am fond of questions… particularly the “why?”)

“Chance,” was all he needed…

So let’s take emotion out of the equation and discuss timeline:

11:25 arrival at PVC. Checked in at the desk with Tim, as always. John Neill was in the office at that time. Asked Tim where mares and foals were and he said in the front pen and also in back somwhere. (The exact location of horses at this moment seem to be a difficult question to answer simply).

11:30 began to walk around facility and photograph horses as I usually do. Mare foal pen observed the day before had the same pairs (still not present were two mare and foal pairs previously photographed). Documented very pregnant mares and noted tag numbers for future reference.

11:45 documented the few “hospital pens” that the public can actually see. Large puddles of water present as we had precipitation and melt off recently.

11:50 began the drive around the facility. Noted water truck spraying the pens in the back. Note there were high winds but no need for additional water as the roads were flooded and the pens had significant puddles. No dust present to go “airborn.”

12:00 documented large “caravan” of manure trucks leaving facility and returning, apparently filled with manure on departure.

12:05 water truck had returned presumably to refill and roadway was now clear. Made my way down to see the area he had sprayed (and caused horses to run).

12:09 discovered the “foal in question.” Photographed and returned for video camera as foal was in apparent distress. Foal and area wet.

After observing the situation as “unchanged” for about 20 minutes, determined baby was not “just fresh from the womb,” but in unmistakeable distress. I went to office. On my way to the office I made two calls to find out if there was someone that was interested in taking the pair.

At the office I informed Tim that a baby was in distress and I knew someone to take the foal/mare that was approved adopter. I told him about the water truck and location. He said someone would go out.

12:35 returned to foal. Water truck was again starting to spray the area. I stood at the point where foal was to indicate he should not continue.

1:42 John Neill and female wrangler drove truck into mare pen. When John got out of the truck I thanked him. He hardly looked in my direction and over his shoulder said that she gave birth first thing am and they knew about the baby… it was weak at birth. I told him I had observed baby and he was still fighting, I was “dismissed.” They removed blue liquid from cab, put baby in cab, drove off.

1:44 I took one last photo of babies mom and drove back to the office to check on babies condition.

John Neill and wrangler were out of the truck but got back into cab when I pulled up. They drove to the back of the facility where the dump trucks were removing manure and a few pens are hidden from view.

I went into office and repeated to Tim that I knew someone to take the pair. I left my number to please call me.

John Neill does not talk to me much after a discussion we had last spring that involved the specifics (who, what, how) of release of ”orphan foals” and the photographs of the colt that died at Broken Arrow after his feet fell off from Calico.(That colt had an adopter prepared to cover all medical expenses). So my expectation was that John would pass info to Tim and then Tim would tell me.

The gal that wanted to take the pair called me not ten minutes after I left PVC, she was in tears. She told me the baby was put down. Tim called me a moment after she did to confirm what she said. I thanked him for telling me.

NOW that is the “what is.”

Reasonable inference: That the water truck was never notified of the foal born in the corner area. As the truck sprayed the horses ran (they always do). The foal (if actually seen early that am) was seen at around 8 am when personnel began rounds to feed. Foal was there for a minimim of three hours before I saw it, most likely more. If the foal was observed to be new (weak) but simply waiting for bonding, it was left to bond. If an injury (or other issue was observed) foal was left in place until I “pointed it out.”

The question would be “why?” on many of these observations.

Draw your own conclusions. But that is the “what is.”

I can bring this information to you. This is still the US and law forbides me to act in any other manner… but for now… our Constitution allows me my voice (sort of).

Death of the Antelope Foal

"Chance," was all he needed...

Didn’t I write this last winter? Didn’t I tell you all about a baby that I knew someone would take that died after a roundup?

Little Hope died after his feet sloughed off from being stampeded during Calico. I said that I would take him and it would cost BLM nothing… but they let Hope die after his vet report (if you remember it had no intake or treatment dates) said he got horsey ibuprofen by the experts as treatment while his hooves literally separated from the bone…

Well today I saw a brand new baby that had been born in the filth of holding… he struggled in the slippery surface with wind gusts of over 35 mph to stand… I don’t know for how long. I decided he needed help and went to the office to get it. He (and mom) needed to go to drier ground and he needed fluids… mom was attentive.

I made two calls and at least two approved BLM adopters would take the pair. I went to the office….

John Neill and a wrangler went out (after I went back to the pen and started photographing again). They drove the truck between my lens and the baby… took a liquid from the truck and drove off… baby in the cab. I looked at mom and she looked at me…

I went back to the office area where Neill and the wrangler were… they got back in the cab and drove through a mare pen and back to the “off limits” area where you can’t see anything.

All day dump trucks were leaving in a caravan taking what appeared to be manure from the back.

I walked in and left my number with Tim Greene to call me with the foals prognosis and repeated that I knew someone who would take the pair.

I got a call from a very upset friend… not ten minutes after I left… she said Tim was going to call me… they euthanized the baby.

I thought I was getting that baby help… but instead they “took out the trash.” (this is my BLOG and that’s how I see these animals treated… like garbage.. not an animal protected by an act of Congress).

I edited this to get it out… it’s not the best edit… but I feel like I’m goung to puke.

BTW: I have not seen the new babies I photographed two days ago… they are “somewhere in the back.”

WE all know BLM will come up with some statement about the baby… that he had an anomaly or was sickly… I can tell you a horse in the Antelope complex would never choose a muddy fecal filled hole to give birth in… an open area in 35 mph winds… I saw those mares run and run at a time of year that they never should be run.

I heard the raidio transmissions one day from the spotter saying horses were by the “cattle guard” and used my vehicle to determine those horses were at least ten miles away regardless of what the BLM “update” says. In that group of “about 14″ spotted only 9 made the area of the trap… three heavily pregnant.

When will BLM stop using a published fiction to facilitate ease to ranchers and contractors to determine when the safest time of year is to stampede our symbol of freedom into cages?

Quick thought (opinion)

Today came testimony on the Budget:



Note that one of the biggest problems with public land management that messses up this country is the lack of what is referenced as a “full cost recovery system.” In other words your Congress rents your land to a tenant that does not pay enough in rent to take care of the property.

Much of this is pushed BY Congress for extractive industry and literally leaves field offices without the needed funds to do their jobs… and that includes doing the REAL ground work to protect your land (and horses) while it puts funds into the pockets of big interests on your back.

They (Congress) are going to do it again. The fees and taxes on extraction are needed to stop “welfare” uses (extraction, livestock) on your land. The idea that allowing these corporations to operate basically on a subsidy to make your life better hasn’t worked… and it’s not going to start.

What is the common definition of “insanity?” Doing the same thing over and over and expecting a different result.

This process is what leaves resources for things like wild horses and burros in a bind. Fast-tracked projects that don’t have enough funding to do REAL environmental assessment will hurt this country in the long run.

Just my ever so humble opinion.

Congress needs to wake up and hear the words: “We don’t inherit the land from our anscestors, we borrow it from our children.” Ancient Indian Proverb

WE as a nation need to decide what it is we will leave to our children. WE need to decide what it is we will teach them. WE need true leadership by example… and I don’t see it.
